Parties and Subject of the Agreement

Last updated: July 2026. These Terms of Service (“Terms”) govern your use of the hosting, domain and related services provided by RataHost (“RataHost”, “we”, “us”). By ordering, accessing or using any of our services you agree to these Terms. If you are entering into this agreement on behalf of a company, you confirm you have authority to bind that company.

Please read them carefully. If you do not accept them, do not use the services.

1. Definitions

“Service” means any hosting, virtual server, dedicated server, domain registration, email, SSL or related product supplied by RataHost.

“Customer” or “you” means the individual or entity that orders a Service.

“Account” means the client area, control panel and billing record associated with you.

“Content” means any data, files, code, media or communications stored, transmitted or published through a Service.

“Billing Period” means the recurring term you select at checkout — monthly, quarterly, annual or otherwise.

2. Account Registration and Security

You must provide accurate, complete and current information when opening an Account, and keep it up to date. Registrations using false, incomplete or third-party details without authorisation may be refused or terminated.

You are responsible for all activity that occurs under your Account, including actions taken by anyone you give access to. Keep your passwords and API credentials confidential, use strong and unique passwords, and enable two-factor authentication where offered.

Notify us without delay if you suspect unauthorised access. We may require identity verification before processing sensitive requests such as password resets, ownership transfers or refunds.

3. Services and Delivery

Most services are provisioned automatically once payment clears. Some products — dedicated servers, custom configurations, or orders flagged for review — may require manual setup or verification, and we will tell you if that applies.

Service specifications, including storage, bandwidth, memory and CPU allocations, are those published on the relevant product page at the time of order. We may improve or adjust specifications, but will not materially reduce what you have paid for during a Billing Period.

4. Fees, Billing and Renewal

Prices are shown on our website and in your client area. Unless stated otherwise, fees are payable in advance for each Billing Period.

Services renew automatically at the end of each Billing Period at the then-current rate, unless you cancel before the renewal date. Invoices are issued ahead of renewal; it is your responsibility to ensure they are settled on time.

Late payment may lead to suspension. Accounts that remain unpaid may be terminated and their data deleted — see section 15.

Any taxes, duties or bank charges applicable in your jurisdiction are your responsibility unless we are legally required to collect them.

5. Refunds and Money-Back Guarantee

Eligible shared hosting plans carry a 30-day money-back guarantee: if the service does not suit you, request a refund within 30 days of the initial order and we will refund the hosting fee.

The guarantee does not extend to: domain registrations and renewals; SSL certificates; dedicated servers; licences; setup or administration fees; or renewals of an existing service. It applies to a first purchase, not to repeat orders of the same product.

Refunds are not available where an account has been suspended or terminated for breach of these Terms.

6. Acceptable Use

You may use the Services for any lawful purpose, provided you do not compromise the stability, security or reputation of our network or the experience of other customers.

You agree not to use a Service to send unsolicited bulk email, to run open mail relays or proxies, to conduct port scanning or penetration testing against systems you do not own, to launch or participate in denial-of-service activity, or to distribute malware.

You must comply with the laws that apply to you and to the jurisdiction in which the service is hosted, and with the acceptable use requirements of our upstream providers and data centres.

7. Prohibited Content

The following may not be stored, served or linked to from our infrastructure:

  • Material that infringes copyright, trademark or other intellectual property rights;
  • Child sexual abuse material, or any content sexualising minors;
  • Content that incites violence, terrorism or hatred against people on the basis of who they are;
  • Fraudulent, phishing or deceptive material, including fake login pages and counterfeit storefronts;
  • Malware, exploit kits, credential dumps or stolen data;
  • Material unlawful in the jurisdiction where it is hosted or where it is directed.

We do not routinely monitor Content, but we will act on credible reports and may remove material or suspend a Service where we reasonably believe this section has been breached.

8. Resource Usage and Fair Use

Shared and reseller plans operate on shared infrastructure. Resources described as “unlimited” are subject to fair use: they are unmetered for normal website workloads, not a licence to consume capacity that degrades service for others.

Activity that may trigger a fair-use review includes sustained high CPU or I/O load, using the account primarily as file storage, backup or a download mirror, running resource-intensive background processes, or operating public torrent, streaming or proxy services.

Where usage affects other customers we will normally contact you first and suggest a suitable plan. We reserve the right to throttle or suspend where the impact is severe or immediate.

9. Domain Names

Domain registrations are governed by the policies of the relevant registry and ICANN, in addition to these Terms. We act as an intermediary; registry decisions are outside our control.

You are responsible for keeping registrant contact details accurate. Registries may suspend domains with demonstrably false WHOIS data.

Domains renew automatically unless cancelled. If a domain expires it may enter a redemption period with additional registry fees, and after that it may be released and registered by anyone. We send renewal reminders as a courtesy but cannot guarantee recovery of an expired domain.

Domain fees are non-refundable once a registration or renewal has been submitted to the registry.

10. Shared and Reseller Hosting

Shared hosting places multiple customers on one server with isolated accounts. Resellers are responsible for their own end users, for first-line support to them, and for ensuring those users comply with these Terms.

We may move accounts between servers for maintenance, capacity or security reasons. Where a move requires action from you, we will give reasonable notice.

11. Virtual and Dedicated Servers

Unmanaged virtual and dedicated servers are supplied with root or administrator access. You are responsible for the operating system, applications, updates, configuration and security of the server. Our support covers the underlying hardware, network and virtualisation layer.

Managed servers include administration as described on the relevant product page. Even on a managed plan, you remain responsible for your own application code and content.

You must keep server software patched. Servers compromised because of unpatched software or weak credentials may be taken offline to protect the wider network, and restoring them may be chargeable.

12. Backups and Your Data

We take backups for our own operational and disaster-recovery purposes, and will make reasonable efforts to restore data on request where a backup exists.

Backups we hold are not a substitute for your own. You are responsible for maintaining independent, current copies of your data and configuration. We do not guarantee the availability, completeness or age of any particular backup, and we accept no liability for data loss where you have not kept your own copies.

Off-site backup space is available as a paid add-on for customers who need it.

13. Availability and Service Levels

We target 99.9% network availability, measured monthly and excluding scheduled maintenance.

Scheduled maintenance is announced in advance where practical and carried out in low-traffic windows. Emergency maintenance may be performed without notice where security or stability requires it.

Availability targets do not cover downtime caused by your own applications or configuration, by third-party services, by attacks on your site, or by circumstances described in section 18.

14. Support

Technical support is available through the ticket system in your client area, and through the other channels listed on our contact page.

Support covers our infrastructure and the services we supply. It does not extend to writing or debugging your application code, third-party software we do not provide, or design work — though we will point you in the right direction where we can.

We ask that communication with our team remains civil. We may decline to continue a conversation that becomes abusive.

15. Suspension and Termination

We may suspend a Service where payment is overdue, where these Terms are breached, where a service is compromised and presents a risk to others, or where we are legally required to.

Except where an immediate risk exists, we will normally contact you first and give a reasonable opportunity to resolve the issue.

You may cancel a Service at any time from your client area; cancellation takes effect at the end of the current Billing Period unless you request otherwise.

After termination, account data may be deleted permanently. Please download anything you need before cancelling or letting a service lapse.

16. Privacy and Data Protection

We collect and process personal data as described in our Privacy Policy. We do not sell customer data.

Where you store other people’s personal data on our infrastructure, you are the data controller and we act as a processor on your instructions. You are responsible for having a lawful basis for that processing and for meeting your own obligations to those individuals.

We may disclose information where legally compelled to do so, and will notify you where we are permitted to.

17. Intellectual Property

You retain ownership of your Content. You grant us only the limited rights needed to host, transmit, back up and display it in order to provide the Service.

The RataHost name, brand and website content remain our property. Nothing in these Terms transfers those rights to you.

If you believe material hosted by us infringes your rights, contact us with details of the work, the location of the material and a statement of your authority to act.

18. Limitation of Liability

The Services are provided on a commercially reasonable basis. To the fullest extent permitted by law, we exclude implied warranties of merchantability and fitness for a particular purpose.

Our total liability arising out of or connected with a Service is limited to the fees you paid for that Service in the three months preceding the event giving rise to the claim.

We are not liable for indirect or consequential loss, including lost profits, lost business, lost goodwill or lost data, even where advised such loss was possible.

Nothing here limits liability that cannot lawfully be limited, including liability for death or personal injury caused by negligence, or for fraud.

19. Indemnity

You agree to indemnify RataHost against claims, damages and reasonable costs arising from your Content, your use of the Services, or your breach of these Terms — including claims brought by your own customers or end users.

20. Force Majeure

Neither party is liable for failure to perform caused by events beyond reasonable control, including natural disaster, war, civil unrest, epidemic, government action, sanctions, large-scale network attack, or failure of upstream carriers, data centres or power supply.

21. Changes to These Terms

We may update these Terms as our services and legal obligations change. The current version is always published on this page with its effective date.

Where a change materially affects your rights we will give reasonable notice by email or through your client area. Continuing to use the Services after a change takes effect means you accept the revised Terms.

22. Governing Law and Disputes

These Terms are governed by the laws of Georgia, where Rata LTD is registered, and the courts of Tbilisi have jurisdiction — without prejudice to any mandatory consumer protections available to you where you live.

Before starting formal proceedings, we ask that you raise the matter with us so we can try to resolve it directly. Most issues are settled quickly that way.
